3.a).- As the service provider, EROSKI, S. COOP. is bound to provide the services offered on THIS MEDIA AND/OR DIGITAL ENVIRONMENT, to effectively guarantee secrecy with respect to all communications that may be made with the user and to respond to any complaints that may be made.
3.b).- In case of maintenance, repair, updating or improvement of the services, EROSKI, S. COOP. is entitled to temporarily suspend access to THIS MEDIA AND/OR DIGITAL ENVIRONMENT, without prior notice, and to reserve the right of provision or cancellation of the services. Notwithstanding this, it shall endeavour to inform the users of the same, providing the circumstances permit.
3.c).- EROSKI, S. COOP. does not directly or indirectly guarantee the information or services offered, except for guarantees that must be provided pursuant to applicable law or which are expressly described in an agreement between this company and the user.
EROSKI, S. COOP. does not guarantee any content supplied by third parties, where the case may be, nor does it guarantee the veracity, reliability, accuracy, appropriateness or convenience of the information supplied with regard to the use made of it by the users or by any other person.
3.d).- The intellectual property rights concerning THIS MEDIA AND/OR DIGITAL ENVIRONMENT are owned by EROSKI, S. COOP. The exclusive exercise of the rights of reproduction, distribution, public communication and transformation also belong to the said company.
4.a).- To register with THIS MEDIA AND/OR DIGITAL ENVIRONMENT, the user must enter a user name and a password which will be their habitual access codes. Users shall be responsible for the safekeeping of their user name and password and shall be liable for any misuse of the same that may be made by any third party as a result of their infringement of this safekeeping obligation.
4.b).- Users must at all times make legitimate use of the services offered by THIS MEDIA AND/OR DIGITAL ENVIRONMENT, in accordance with applicable law, observing the intellectual property rights of EROSKI, S. COOP. or any third parties.
To this effect, the user guarantees that the activities carried out via THIS MEDIA AND/OR DIGITAL ENVIRONMENT will be in accordance with the law, moral standards, public order and good practice and shall in no case damage the reputation or business image of EROSKI, S. COOP. or of any other companies belonging to the EROSKI GROUP for other users of THIS MEDIA AND/OR DIGITAL ENVIRONMENT or third parties.
4.c).- The user shall not engage in any activity causing damage to or alteration of the content of THIS MEDIA AND/OR DIGITAL ENVIRONMENT through the services made available to them by EROSKI, S. COOP., or hinder its correct functioning, and they shall not cause technical problems of any type. They may not transfer any elements liable to carry computer virus or to totally or partially damage, interfere with or intercept THIS MEDIA AND/OR DIGITAL ENVIRONMENT, and neither may they intervene in or alter the electronic mail of other users.
4.d).- The user is exclusively responsible for the veracity of the data provided, and EROSKI, S. COOP. reserves the right to prohibit their access to THIS MEDIA AND/OR DIGITAL ENVIRONMENT in the case of their having provided false or inaccurate data.
5.a).- EROSKI, S. COOP. does not guarantee the availability and the continuous functioning of THIS MEDIA AND/OR DIGITAL ENVIRONMENT and its services.
It therefore accepts no liability for damages of any kind that may arise from lack of availability or continuity of the functioning of THIS MEDIA AND/OR DIGITAL ENVIRONMENT and its services and the use that may have been attributed to THIS MEDIA AND/OR DIGITAL ENVIRONMENT by the users.
Nonetheless, EROSKI, S. COOP. shall do everything within its power for THIS MEDIA AND/OR DIGITAL ENVIRONMENT to remain continuously available.
5.b).- EROSKI, S. COOP. makes personal data privacy systems available to the users, preventing access to this data by third parties. EROSKI, S. COOP. has implemented all the technical and organisational security measures required to guarantee the integrity, confidentiality and availability of the personal data provided by the users.
5.c).- Although EROSKI, S. COOP. has implemented all the suitable security measures to guarantee security in this regard, it does not control or guarantee that the content of THIS MEDIA AND/OR DIGITAL ENVIRONMENT is free from virus or other elements that could produce alterations to the user's computer system (software and hardware) or to the electronic documents or files stored in their computer system.
EROSKI, S. COOP. shall hold no liability for damages of any kind arising from the presence of virus in the content that could produce alterations to computer systems, electronic documents, files, etc.
5.d).- EROSKI, S. COOP. holds no liability and does not control the use made by users of THIS MEDIA AND/OR DIGITAL ENVIRONMENT or of its services and content. In particular, this company does not guarantee that the users make use of THIS MEDIA AND/OR DIGITAL ENVIRONMENT, its services and its content in accordance with these General Terms and Conditions, and, where appropriate, any Special Conditions that may be applicable, or that they do so diligently and prudently.
Neither is this company bound to verify the identity of the users, and it does not verify their identity or the veracity, validity, exhaustiveness and/or authenticity of any personal data provided by its users to other users.
All rights concerning the content of THIS MEDIA AND/OR DIGITAL ENVIRONMENT belong to EROSKI, S. COOP., except those of companies with which it has signed the corresponding contract for provision of content and which are protected by national and international intellectual and industrial property regulations.
The design, images, maps, graphics, brand names, lettering, distinctive trademarks or logos of EROSKI, S. COOP., frames, banners, the software and its different codes, source and object, etc. of THIS MEDIA AND/OR DIGITAL ENVIRONMENT are owned by EROSKI, S. COOP., which legally and exclusively owns the rights of use of the same.
The logos or distinctive trademarks of the other companies making up the EROSKI GROUP are held by each of these companies, which legally and exclusively hold the rights of use of the same and expressly consent to their inclusion in THIS MEDIA AND/OR DIGITAL ENVIRONMENT, where appropriate.
Users accessing THIS MEDIA AND/OR DIGITAL ENVIRONMENT may not copy, modify, distribute, transmit, reproduce, publish, grant or sell the aforementioned elements or create new products or services deriving from the information obtained.
Only viewing and download for personal and non-commercial use by the user is authorised, which may not be extended to third parties or entities.
These conditions shall also be applicable to any graphics or designs appearing on THIS MEDIA AND/OR DIGITAL ENVIRONMENT owned by EROSKI, S. COOP.'s collaborator companies, unless specifically agreed otherwise.
It is categorically forbidden for users to make any alterations to THIS MEDIA AND/OR DIGITAL ENVIRONMENT that could affect its content, such as links and similar items.

COOP. shall endeavour to ensure that the content of THIS MEDIA AND/OR DIGITAL ENVIRONMENT is not of a pornographic, xenophobic, discriminatory, racist or defamatory nature and that it does not incite violence. Likewise, it will endeavour to prevent any circumstances that may be detrimental to users.

Without prejudice to this fact, the following is notified:
7.a).- In order to access and/or use some of the Services, Users must previously supply EROSKI, S. COOP. with certain personal information (hereinafter, the "Personal Data"), which EROSKI, S. COOP. will process and include in a computerised database for the purposes relevant to each particular case, although the data supplied to EROSKI, S. 7.b).- The Users shall be previously and duly notified of all these circumstances by EROSKI, S. COOP. as and when legally required.
7.c).- If the Users supply any personal information belonging to third parties, they must inform the said third parties of the content of the data provided, the existence and purpose of the database in which their data will be included, and the possibility of exercising their rights. They must identify EROSKI, S. COOP. and must obtain consent from the said third party to notify EROSKI, S. COOP. of their data.
7.d).- EROSKI, S. COOP. guarantees that the relevant security measures have been taken with regard to its facilities, systems and databases. EROSKI, S. COOP. also guarantees the confidentiality of the Personal Data. Notwithstanding this, EROSKI, S. COOP. shall disclose the Personal Data and any other information it may hold or which may be accessible via its systems to the competent public authorities if it should be required by the same, in accordance with the legal and regulatory provisions applicable to the case in question. Users are entitled to exercise their rights of access, rectification, cancellation and opposition or withdraw their consent at any time by contacting EROSKI, S. COOP. in accordance with the procedure for exercising their rights described for this purpose in the Privacy Policy.
The EROSKI Group in general, and EROSKI, S. COOP. in particular, have taken on a serious commitment from the start to guarantee security in all their business transactions.
The Electronic Commerce system used by this company is thus housed in a certified and endorsed Secure Server so that all confidential information is sent securely via the advanced data encrypting system SSL (Secure Socket Layer).

In any case, EROSKI, S. COOP. and the EROSKI GROUP companies shall hold no liability for the services provided by the said third parties with regard to complaints of any nature, or any claims that may be lodged in connection with the same.
If any clause contained in these Terms and Conditions for Browsing and Use of EROSKI, S. COOP.'s MEDIA AND/OR DIGITAL ENVIRONMENT were to be declared totally or partially null and unenforceable, this shall only affect that provision or part thereof that becomes null and unenforceable and the rest of the general conditions shall remain valid. The affected provision or part thereof shall be considered to have been removed, unless it is essential to these General Conditions and affects them in their entirety.
These General Terms and Conditions for use and browsing, and any relationship between the user and EROSKI, S. COOP., shall be governed by Spanish legislation.
In case of any dispute deriving from the existence or content of these General Terms and Conditions or the relationship between the user and EROSKI, S. COOP., both parties expressly submit to the Courts and Tribunals to which they are legally entitled.
